PROFESSIONAL REGULATORY LAW

Professional licensing bodies set standards for, and also govern and regulate, the manner in which licensed professionals are required to practice. Professionals under this category may encounter issues of regulation that can impact on their practices and generally need representation at pre-adjudication and adjudication levels.

We have represented with considerable success before such bodies as Council of the Ontario College of Pharmacists, Professional Engineers of Ontario, and Consent and Capacity Board, and understand the principles of law under which these bodies are required to operate.

We are able to represent professionals such as dentists, nurses, doctors, architects, accountants, as well as real estate and insurance brokers, who may face issues of governance before their professional bodies. These bodies are governed by administrative law principles that apply to the legislation and bylaws under which they operate.

Our aim is to safeguard the interest of the professionals and to ensure that their perspective is understood while being treated fairly before the professional body. In general, the due process of law must be followed to permit defences to the professional while the tribunal is also mandated to protect the public interest.
